General 

Modular Seating PTY LTD trading as Modula Living, operates in accordance with Australian laws, including the Australian Consumer Law (ACL). These Standard Terms and Conditions (Terms) apply to all orders of Goods from The Vendor (see front of page for Vendor company and ACN details) (We, us, our or Company). These Terms together with your order form a contract for the sale of the Goods. We will not be bound by any terms and conditions included in any purchase order, sales confirmation or other document or communication from the Client. 

All prices are in Australian Dollars (AUD) and include GST unless stated otherwise. 

We reserve the right to update these Terms at any time. Continued use of our website or services after changes constitutes your acceptance of the new Terms. 

Orders & Payment 

Orders can be placed online, in-store, or via phone.  

Full payment or a deposit is required at the time of purchase unless otherwise agreed in writing. We accept payment by credit card, debit card, bank transfer, and approved buy-now-pay-later providers. Please note that certain payment methods may incur a surcharge. 

If we are unable to successfully process payment for your order, we may reject or cancel your order. 

You must provide complete and accurate information at the time of order and any additional details if requested by us in connection with your purchase. 

All payments are processed using industry-standard encryption and security protocols. However, you acknowledge that despite reasonable precautions on our part, there is a risk of unauthorised access to, or alteration of, your transmissions of data or of information contained on your computer system or on the Site, and therefore you supply this information at your own risk. To the maximum extent permitted by law, we are not liable for any loss or damage of any kind, including, without limitation, liability to a third party, which you may suffer or incur as a result of such activity. 

Delivery & Pick-Up 

Delivery times are estimates only and may vary based on location and product availability. Modular Seating PTY LTD is not liable for delays caused by third-party delivery services. It is your responsibility to ensure accessibility for delivery. Additional charges may apply for re-delivery or difficult access. 

Modular Seating PTY LTD only ships within Australia. 

Freight and delivery charges depend on your location, size, weight and quantity of product(s) ordered.  

Orders for multiple products may be split across multiple deliveries depending on where it was shipped from. 

If no one is available to accept delivery at your nominated address, Modular Seating PTY LTD or its carriers will attempt to contact you to arrange for delivery at a different time. We may charge you an additional delivery fee for re-delivery of your order.  You acknowledge and agree that any person at the delivery address who receives and signs for the delivery is authorised by you. It is your responsibility to ensure that you provide Modular Seating PTY LTD with a delivery address where someone will be present to sign for the consignment. 

It is your responsibility to check that the correct product has been delivered and is in reasonable condition before signing for it. 

If the product or any packaging appears damaged on delivery, you should refuse the delivery and contact us immediately at [email protected]. If you have already accepted a product and later discover that it has been damaged or is missing parts or is otherwise defective, our Returns Policy set out on the Site will apply. 

We strongly recommend taking photos of the damaged product or packaging as received, to support your claim. 

Online Shopping for Textiles 

Textiles may appear differently on screen than they do in real life. This may be caused by your screen settings or the settings that were used in the production of the original image. Colours and textures of textiles may appear differently on screen compared to real life due to variations in screen settings and photography lighting. 

Please be aware of this and take it into account when you are reviewing your order. 

Cancellations & Changes 

You may request to cancel or amend your order within 24 hours of placing it by contacting our team. After this period, cancellations may not be possible, particularly for custom or made-to-order items. 

If a cancellation is approved, we may charge a restocking fee to cover administration and restocking costs. This fee will be 20% of the total item price and deducted from your deposit.  

Change-of-mind cancellations are not permitted after 24 hours of placing your order or if you have picked up your item or it has been delivered, except as required by law. 

Returns & Refunds 

Our goods come with guarantees that cannot be excluded under the ACL. 

If your product is faulty, not as described, or not fit for purpose, you are entitled to a refund, replacement, or repair. 

Customers are responsible for return shipping costs unless the item is confirmed to be faulty. 

Warranties 

• Warranty is only applicable to the original purchaser. 

• The warranty commences from the date of collection or delivery of your purchased products and does not restart if the item is replaced or repaired. 

• All original invoices and receipts must be provided. 

• The warranty is only applicable for normal domestic use. 

• Modula Living reserves the right to decide whether the claim is due to wear and tear, or a manufacturing fault. 

 Exclusions: 

1. Normal wear and tear on covering, components & timber surfaces. 

2. Damage caused by sharp objects, burns, spills, body fluids, pets, improper cleaning, chemicals, exposure to sunlight or excessive heat. 

3. Furniture used for commercial, rental or trade purposes (non-residential use). 

4. Scars, vein lines, wrinkling, grain & shade variations in leather. 

5. Normal settling of seat foam and soft fillings. 

6. Fabric pilling. 

7. Damage caused by the customer or their contractor during handling and transportation of products. 

8. Failure to follow Modula Living care instructions or manufacturer’s care instructions. 

9. Electric components are not covered for home voltage fluctuations or power surge. 

10. Any products sold as floor stock, repaired products or products with defects where it has been brought to the customers attention before purchase. 

Claim Process 

If you have a concern with a product you have purchased from us and believe it is covered by our warranty, please complete the Warranty Claim Form to raise a support ticket.  Attach any photos that can assist us with your claim, as well as your original invoice.
